The Gillard ‘I’m the boss’ show performed yesterday when Gillard rolled up her sleeves and made an unprecedented announcement when she called the 2013 election for the 14th September – some 227 days away.

24 hours later it would seem that she knew something that we all found out about today – NSW police acting on an arrest warrant issued by Victorian Police have arrested Member for Dobell Craig Thompson in his electorate on some 149 counts of fraud, and other criminal charges relating to the misuse of HSU funds whilst he was an employee of the Union.

The Thompson arrest a day after Gillard’s election stunt immediately throws into question as to why pick September,  and why announce so far out from the proposed date.

Gillard has multiple issues to deal with in the first half of this year, i.e. Slipper, Obeid fallout, Mike Williamson, her own AWU scandal and the closing police investigation over her involvement,  and then there was the policy matters on a National Disability Scheme, and the Gonski report reforms on education, and to now add an election mode to all the other events – it makes her a masochist with immense capacity for pain given what she will drag her Government through and force them to endure in the coming months.

In the weeks and months ahead the electorate will be rejoicing in her demise as each of the above sink her in a slow boil of her own choosing.  There will be egg throwing, and other insulting verbal barbs offered and directed at Gillard – all as a cynical goodbye and good-riddance type of celebration for all her decisions over the past three years that have subjected this Nation to the worst governance in our history.

The Thompson arrest the day after he election announcement reeks of inside knowledge. Gillard denied she had knowledge of the impending Thompson arrest today when fronting the media at a Bundaberg flood inspection tour.

This denial is now questioned on the evidence presented by the NSW police at their media interview when they stated the Victorian police issued a warrant to Thompson before Christmas asking him to volunteer himself to Victorian police for questioning – Thompson refused the invitation which initiated the arrest today.

If Thompson knew his arrest was imminent – there is no way that Gillard would not be made aware of that information. Gillard chose her words carefully when responding to the media today wanting to not answer any questions at all on the Thompson arrest.

Thompson’s solicitor Mr McArdle in his on camera News 24 interview stated he was asked to present himself to Victorian police for questioning before Christmas 2012.  McArdle made the point that is was not an arrest warrant – but an invitation which Thompson refused to accept.

Gillard would have had to know what was afoot when this happened before Christmas – she had to have known an arrest was imminent.  Whether she had prior knowledge becomes the mute point and is a matter for further investigation.

If so she misled the media today.

If so the reason for the election call is also exposed and draws more fire at Gillard for her poor judgement in an attempt to stay a motion of no confidence if Thompson is forced to resign and a by-election sees the seat lost. Add the pending Slipper resignation and the Government is no longed in a position to govern unless additional Independents pledge their support.

What is more disturbing is news that Gillard’s own internal polling within Caucus is vulnerable – calling the election was a deliberate attempt to dissuade would be challengers from staging a ‘spill’ – be it Rudd, or Shorten – neither who were aware of the election call.  There may have been more challenges but we will never know now. Gillard skiddled them like nine pins with her election call – she is no shrinking violet and if she was not a criminal – she might be someone we could all be proud to have as our PM – well … there would have to be a lot of other personality modifications as well before she would ever get my vote .

As the Nation recovers from the ‘shock and awe’ desperation Gillard presented yesterday at her National Press Club address – the reality of what a 230 odd day election campaign represents is emerging from the fog and clouded waters.

What was Gillard’s motive – EYE-BALL covered this yesterday in some detail – it has been revealed that her Cabinet were largely left in the dark about the announcement – Gillard admitted that The Greens, Oakeshott and Windsor were advised shortly before she announced the election date – Ministers like Bill Shorten and Crean were not advised.

Australia’s economy tethers with continued large firm job losses and closures,  the flood and bushfire crisis across the eastern states were pushed aside to make way for Gillard’s attempt to muddy the political landscape.

Lack of respect for Natural Disaster efforts:

Her announcement came right in the middle of the aftermath of the floods and their ongoing cleanup, and when combined with the ravaging bush-fire damages, why did she pick yesterday to announce the election?  

The rebuild up and down the eastern seaboard will take months and even years.  Gillard’s announcement proves again the stupidity that comes from her and her advisers – or ‘poor judgement’ as Abbott called it in his address today.   The election announcement was a ‘crash-stunt’ meant to deflect the continued AWU scandal attacks and the police who are closing in.

Without and knowledge of how disrespectful she was being – Gillard’s election stunt diminished the efforts of the volunteers, the emergency services,  the victims and the hero’s all confronting the flood crisis, the bush fire damage up and down the eastern seaboard, and  all giving tirelessly to defend their communities.

Gillard chose to announce rather then hold back until the Nation was on the way to recovery.

This was nothing less than her own personal survival plan and designed to give her, her the best chance at being re-elected.

Whatever the Cabinet Ministers come out and say in the days to come – they were caught short and their true opinion will never be heard.  They are all now in survival mode and one might ponder which might be the greater natural disaster – Gillard’s leadership, the floods, or the bushfires.

The AWU Investigation:

Gillard is aware of the AWU investigation progress, and she feels threatened as if directs itself toward her testimony in the face of the newly uncovered evidence, and new witness statements.

The AWU investigation is closing in on Gillard and she had to respond if she was to prolong her survival – and she did by announcing the longest election campaign in history.  

Her immediate aim is to guarantee her leadership through to that election.  She then hopes to stall the Oppositions pursuit of her in the house over her AWU involvement.  That is a hail mary as she cannot control the Opposition and their agenda against her.  But by giving them an election to focus on she was at best hoping to distract them from the AWU pursuit.

Gillard knows her days as Leader and as a politician are numbered if this AWU scandal was allowed to run amok during an election year.   This again proves how desperate she is – and the electorate will not be fooled – nor should the Opposition – this election stunt as her last throw of the dice.

The Economic Void:

Gillard’s stunt gave us nothing on ALP economic policy, yet she challenged the Opposition to provide their economic policies saying there was now no excuses to not have them fully costed well before the election.

What of Gillard’s failures as an economic manager – they loom large and real – here is two relative examples …

  • The the failure on delivering a promised budget surplus for 2012-13 – back-flipped on during the Christmas recess in the hope that it would not have media churn in the new year.
  • The zero tax collect for the second consecutive quarter for the new MRRT was also doused as a story that would have had its day in Parliament next week.

Gillard sees herself as untouchable – as someone who is unable to  believe in her failures … she moves on and that is what she has done again …

Cabinet and Caucus are still to discuss and endorse the move – not that they will have any say in reversing the decision.  What Gillard wants Gillard gets is the new slogan doing the rounds of parliament House at the moment.  Her arrogance will have isolated her further.

As a financial commentator – Gillard’s will to introduce the National Disability scheme,  and the Gonski review recommendations before the election demonstrates another side of her desperation.

The $10-$15 billion of new spending these initiatives will trigger, and under a Government already drunk on the over-spend of recent years – should be looked at for what it really represents – sheer lunacy.

Given the odds for a ALP victory – why is Gillard so determined  to exhaust the Treasury and leave Abbott’s task that much harder?  

Where is the accountability given the hardship Australians are enduring in the aftermath of the floods and bushfires – where is her respect for the office she serves – and the people she represents?  Gillard has no economic credentials and for her to be demanding Opposition economic policies is political suicide.   She will spin this into another ‘misogynist’ rant trying to punish Abbott because she could not get her way.   She is more than dangerous, she is vile and nobody in the Government can stop her.  

Howes, Shorten, Ludwig and the like who put her in the chair now have to do what they did to Rudd … they haven’t the balls because it will make their June 2010 action look that much more damaging to the ALP brand.

most of Australia does not give a hoot about her election stunt – the percentage of people who care about the election announcement would fit into the prisons around the Nation – the irony is that some of them will be serving in those prisons at some time in the future.

Dismiss the media – dismiss the politicians – who is left that is affected or even interested by this early election call?  

Why not an early election?

Gillard could have easily have called an early election and that would have been news … it would have shocked everybody and given her creditability that may have won her support and votes.

Her advisers were not brave enough to debate that option with her – this election decision is all Gillard’s and she is now exposed and isolated more than ever – if only some of the ALP caucus were brave enough to do the right thing.  Their squeamishness is obvious – two PM’s assassinated in three years … the sad fact is that this one is more justified than the previous and therein lies the rub – this Government has completely lost its way – they can’t lead, they have no idea what’s up or down, they all are concerned about pre-selection contests and whether they are short listed.   

Failed ALP Policies: 

It’s time for some reality checks of failed promise’s by Gillard and her Government.   As a basis to justify the MRRT the Government promised a employer contribution to Superannuation taking it to 12%.  

Also – there was promised company tax relief for business – both these promised policies have failed to eventuate because the collect from the MRRT in the first six months has been zero. Gillard has moved on and there there has been no talk about how the promised super and tax relief are now to be funded.

If we move to other areas – the NBN – what a clusterfu_k that is – and now they have to find a way to flood proof the existing rollout before they can move on to new rollouts …

Then there is the health issues all around Australia with waiting lists getting longer and hospital beds being closed.

This government talks a good game but it is all hollow and no substance … what about failed border issues and an immigration policy that has stalled because nobody has an answer.

This PM makes these grandiose statements and when they fail – all to frequently – she makes a new round of initiatives i.e. education and recommendation from the Gonski report, and the National Disability scheme. How is she going to fund these new policies when she has not funded to shortfall from the MRRT expected tax collect.

You want to talk about economic management – there is no worse example of a PM spending for re-election purposes. She has no real interest in the welfare of the people impacted by her failed policies – she moves on and tries to capture a new audience and the Australian media follow her like lapdogs hanging on her every word waiting for their next headline.

Our pathetic Media:

It truly is pathetic – Gillard yesterday, and now Crean this morning on ‘News 24’ called for the Opposition to lay out their policies and have them fully costed.  Crean should know better – this Government has not delivered on any of its policies within budget forecasts.  Crean offered up an excuse this morning that it was a revenue problem – he should be taken out the back and wacked for being so dumb …

How dare Crean blame reduce revenues when they actually grew in the last two years by almost 10% and 8% respectively.

These growth numbers represent the highest revenue growth years since 1996 bar three (3). The problem is never about revenues – it has always been about expenditures and for Crean to be allowed to go unchallenged on his statements this morning, says more about how much of a void there is in our media presenters who actually understand economics and financial accountability.

ABC’s ‘News 24’ presenter Michael Rowlands was out of his skin trying to give Crean his platform for comment – both Rowlands and the ‘lipstick’ that sits beside him have their own ALP agendas – any creditability as political commentators they think they have is laughable.

Another ABC presenter Barry Cassidy was also given his opportunity to spruik the ALP message on the same program.   Cassidy as you know served as Bob Hawke’s press secretary.  It is a shame he lost his way as far as objectivity is concerned – get off you horse Barry and think about giving the game away, or go back to when you had some journalistic creditability and rediscover that objectivity.

The ‘News 24’ is a great concept and initiative – I do watch the live interviews but as for intelligent and inciteful commentary, Paul Jones, and Leigh Sales are about the only presenters who are brave enough to ask the tough questions.

The ABC don’t have a financial journalist presenter worth a pinch of salt – they pay so called experts to guest appear and that then lends those paid for comment speakers the soapbox to make comments that go unchallenged, and not necessary on topic, or provide the answers the audience want to hear.

This blog-site is mostly about macro issues, yet in all all the tripe that is dished up by Politicians and their leadership, it all focuses on the micro issues.   The media never ask the Politician to answer the question when they avoid it – when it does happen it never changes the message.  Politicians have been allowed to hoodwink the media and now treat it as their own message delivery system.

No media presenter goes to history in a big way – even recent history could prompt a question on why policies failed – why is their no tax collect from the MRRT – was it a bad tax – did Gillard water it down ahead of the 2010 election to give herself a shot of winning that election. If you recall the Mining lobby were running a staunch campaign against Rudd over the MRRT … was Gillard’s capitulation the reason the MRRT has a zero tax collect?

The answers given to this question are about commodity prices, about state royalties, about the ‘super-tax’ concept  – nobody will call it a bad tax and that the Miners beat the Government down on its original intent and collect.

Commodity prices, particular iron ore are seasonal – RIO, BHP, and Fortescue all announced record export volumes – and there we have it again – Crean says a fall in revenues I say the RBA and Government’s flawed inflation targeting policy, and its impact on continued high interest rates.

The economic upshot is that the Government has no idea what drivers are working in the economy, and/or what influences are impacting on it negativity. For them it is all a crap-shoot …

Summary:

The best thing Gillard could have done is go early – it would have served her better as well as the Nation.

As it stands – the continued economic downturn that will happen during the election campaign will further damage Labour as it should.

The damage Gillard can do in this 8 odd month period is serious – Abbott has to work at getting her out as early as possible, and to that aim he should be pressuring the WA and Victorian Premiers to do him a favour and get the AWU investigation to its conclusion as soon as it can.

The ALP caucus is asleep behind its Pied-Piper leader – there is no way any of them will stand up and deliver what the electorate demands …

The National Press Club address by Gillard today baited her hooks and Opposition Leader Tony Abbott chomped hard.

Given where the police investigations are on the ‘Power of Attorney’ document, and how Parliament ended last year with the Opposition clearly pushing Gillard over her involvement in the AWU scandal – Gillard had to pull a stunt to throw the Opposition of her scent when Parliament resumes next week.   She knew her days were numbered unless she could get Abbott to change his AWU scandal focus.

Gillard played the election card when she announced in today’s address a 2013 Federal election to be held on the 14th Sept.   Nobody saw this coming, and giving away the surprise of the Government controlling when the election is called is a desperate move by Gillard.

It has never been done before and the motive behind the move is pure medieval and sinister.  

The decision provides what is in effect an almost nine month election campaign.   Most of what Gillard offered up as justification is  not relevant.   Her chant for every opportunity to have all policy’s costed has already been discounted by the Opposition.   There is the May budget, and the 2013 end of year accounts will not be available until after the election date.   How can any responsible person expect to structure policies when the Treasury position is not fully known.

This is Gillard’s last throw of the dice in trying to prevent Police knocking on her door seeking her admissions to her involvement in the AWU scandal.

Tony Abbott held a Press conference an hour or so ago and already he is talking about running in Gillard’s race.  

Abbott did not respond in ways that would indicate he wants to run his own race.   His response should have been to call Gillard’s ploy out for what it is – he should have told the Australian people that the Opposition will pursue Gillard over the AWU scandal and it would be extremely unlikely that the Government will still be the Government when Sept 14 comes around.

No – Abbott again showed that he happy to run behind Gillard in Gillard’s race with Gillard setting the agenda and the pace – he looked weak and opinion is reserved until after his reply at the National Press Club tomorrow.

To vilify Gillard’s Leadership position in that once an election has been called – there is no history where the Leader is removed or displaced in the election time-frame.

It is quite possible that Peter Slipper will resign his Parliamentary position to guarantee no loss of Parliamentary pension rather than face fraud charges.  

Craig Thompson has declared his intent to fight his charges but the evidence is overwhelming and his pension is not guaranteed as is Slipper’s – he does not have the time in office to be exempt.   As a result his pretense to prolong his court case to serve Gillard’s term in office will be his legal teams agenda.   The question I want answered is whether Roxon will assist in that endeavor?

And in addition – the Obeid ICAC inquiry will be ongoing all throughout 2013 and this will only damage the ALP brand further.   

Everything in Gillard’s Press Club address was window dressing her election stunt – she gained approval for the early election from the Independents and The Greens, yet left her caucus out of the loop – how many of her Ministers were aware of the Election stunt?  

I cannot recall such contempt from a self-serving politician.  Gillard stands alone as the great spin manipulator – Shane Warne she is not – but in her domain consisting of a kindergarten full of inept ALP MP’s and Senators – she with her ‘schoolmarm’ intellectual makeover appears to be holding sway.

I’m sure many others will see different motives and angles – but this stunt by Gillard has immediately put Abbott off his game-plan for next week.  It has forced him into Gillard’s race.

Abbott fronts the Press Club tomorrow and unless he calls Gillard out over the AWU scandal and its near term outcome, unless he sets his own agenda – i.e. to aim for an early disolvement of the Government as the numbers fall – Abbott is not fit to be our next PM.   He has for two plus years allowed Gillard to dominate him – his steady as she goes – his Carbon Tax campaign – his response to the misogynist tag – Abbott has to lead if he wants to be leader and tomorrow is D-Day for him.

The 2013 Election Year is eagerly awaited – the would be Gillard slayers are primed and ready for a blood-sport the likes Australian politics have not seen for generations.

The Gillard backers with their heads in the sand, and their arse’s exposed to all the elements of political attack plan to fight to the death.

They have chosen history and destiny as their campaign banner-line – they believe Gillard is the only option they have as Leader and are willing to stake their political future in that self-serving lie.

ALP supporters in their millions are divided on Gillard and her mysandrist brand of politics – her gutter mouthed, her slum-dweller slurs, her policy void,  someone with a feminine instinct for spending other people’s money,  a self-confessed atheist, a childless woman by choice, an unmarried woman by choice, an abortionist, a socialist,  a criminal who is better suited to first fleet type banishment, and a banished lawyer never able to practice again – our Prime Minister personifies evil in the eyes of all those disenfranchised ALP supporters, and coalition supporters all lined up to take her head – the Nation feels  conflicted because Gillard won’t go willingly.

The ALP wanders can not and never will vote for Tony Abbott – his Leadership credentials are equally weak and devoid of policies that traditional ALP supporters can support.    Yet Abbott in no way resembles the corrupt history and legacy the ALP caucus has allowed and legitimised through their collective choices to allow Gillard’s criminal past to go unchecked.

Then there is the Craig Thompson, and the Peter Slipper affairs that also question the integrity of the ALP caucus and their inability to act and behave accordingly when corruption is exposed and demands action to be taken.

The ALP as a party are polarised – Gillard has the support of the Unions and every ALP caucus Member is a member of a Union.  The ALP demands absolute loyalty else the Member risk’s dis-endorsement.  

The perfect examples of this have been exposed by the recent ousting of NT Senator Trish Crossin for Gillard’s ‘Captains Pick’ in Nova Peris.  Then there was the shock announcement  by Rob McClelland that he would not seek pre-selection for the seat he has held since 1996.

The history of McClelland and his legal battle with Gillard during the mid 90’s over the then developing AWU scandal is well known.  His outspoken and continued support for Kevin Rudd saw his political flame dim, and then extinguish because of Gillard’s Union support base and their willingness to continue to cover up her criminal past.  

Senator Crossin was also an avid Rudd supporter.

Both these ousting’s have a story of their own to tell – but in this election year – their miffed sacking, and extracted capitulation are all about clearing the waters for what is to follow.

AWU Scandal Review:

Returning to the 2012 AWU scandal revelations – Alan Jones interviewed Mike Smith on his 2GB breakfast show late last year.  During that broadcast Jones and Smith calibrated the AWU scandal in a chronological and damaging time-line that exposed and laid Gillard’s involvement bare to the bone.  There is no escape for her and her guilt, only the course of events that are to follow in upcoming weeks and months during this election year.

The obvious question arises – how can the ALP caucus continue to stand by and allow this travesty of Justice against the AWU Union Members and the funds that Gillard helped defraud, co?

How can the seriousness of these revelations go unchallenged within the Party room?

The public’s perspective on the ALP’s inaction in censuring Gillard is the challenge ALP supporters face.

Why has she not been asked, or told she has to stand aside until the allegations can be dealt with by due process?

The tainted ALP rules on loyalty:

A pattern has emerged on these issues – the Craig Thompson affair and how the ALP allowed him to serve their purpose in holding onto Government when he faced the most serious of allegations and the now charges that are about to be heard before the courts.

Then there is the Peter Slipper misogynist tweets, and his obvious abuse of Ministerial expenses resulting in new charges being laid for their fraud component.

The Government has allowed both Mr Slipper and Mr Thompson to continue to vote for the Government whilst these serious allegations are under due process of law.   If the Government did not have these votes at their disposal – a new election would ensure.

How can the ALP caucus maintain any creditability with the electorate when they allow these three criminals, Thompson, Slipper, and Gillard to continue to serve the Party and support the numbers that allow this Government to hold office?

Surely – we have a justice system that must be served, and be seen to be served.  

Gillard’s own demons:

Since the early 1990’s Gillard has known within herself of her criminal actions –

Her claims in defiance to all the allegations – ‘I did nothing wrong’ – and spoken in the face of overwhelming evidence every time this matter has been raised during the last 20 odd years is not good enough.

In the face of the new investigation and fresh evidence her – ‘I did nothing wrong’ comment does not cut-it.   Gillard no longer has doubt, or lack of evidence to allow her to claim she did nothing wrong.

It is just another lie upon all the other lies – the same lies she has told herself all the years in between.   Gillard obviously believes in her own mind she did nothing wrong – her offering of ‘young and naive’  to Glen Milne in her 2007 interview is not a mitigating circumstance.

Her fellow Partners at Slater and Gordon believed she did something wrong – they sacked her.   Allow the comparison of Gordon Gretch who did not think he did anything wrong, he believed he was acting for a greater good – look what happened to him.

Gillard’s continued tenure as our Prime Minister does irreparable harm to this Nation – serious and damaging harm from within that is destroying any respect within the electorate for the political process that Govern’s this Nation.

Abbott and his team can take or claim any higher moral ground on this matter – Slipper was one of their own and they all knew what he was about yet continued to pre-select him for all of his political career.   

Abbott’s inability to topple Gillard on the preferred Leader poll whilst the AWU scandal dogged Gillard for all of 2012 indicates his own Leadership failings.

If Gillard ‘did nothing wrong’ – her first course of action would have been to sued for wrongful dismissal – instead Gillard fell on her sword knowing she had exposed her Partners and Slater and Gordon to serious conflict of interest and professional indemnity  issues.   She has never practiced Law again because she is under threat of a disbarment if she did.   Is there ‘I did nothing wrong’ evidence in those actions?

The Victorian Law Society should have investigated the AWU scandal when it first became public.   When one of their own is accused of mis-conduct they have an obligation to make their house clean once again … they did not act – why not?   

Even as this scandal developed further late in 2011 and all last year – the Law Society should have set themselves to investigate the matter to find out how Slater and Gordon escaped over the breach of trust with their real AWU client.   

The bigger lie involved is in how the AWU and the Slater and Gordon Law Firm cover-up the fraud and mis-conduct of Gillard.  Who proposed the cover-up terms, and who agreed?

As a consequence this allowed Gillard to escape and avoided answering to the Law Society, and the Criminal Courts to face our justice system.

For her to be allowed to rebuild a political career with this criminal past out there and in the hands of several co-contributors,  and to then assassinate a sitting Prime Minister to become our un-elected Prime Minister – with all the AWU baggage still in tow – proves the extent in how our justice system failed at the time,  and how the ALP and its Union platform have corrupted all those who represent us.

On a larger scale – it demonstrates the decadent morals and  integrity of the Australian Labour Party.    For them to accept a PM responsible for a Union Members fund fraud involving $millions only confirms the Unionist lust for power, and the ‘slush-fund’ spend they set aside to embed the corruption at senior delegate levels.

Current Status of the AWU scandal:

The AWU scandal  is currently being investigated by Victorian and Western Australia fraud squad investigators.  Interviews with several key personnel linked to the most serious breach against Gillard – that being the  ‘Power of Attorney’ – [edited – did say ‘Stat Dec’] – produced in the purchase of the Fitzroy St property

The allegations are that the document was signed by Gillard as a witness to Ralph Blewitt’s signature in absenteeism, and then backdated to legitimised the purchase of the Fitzroy St property in Blewitt’s name.   These are serious offences if proved and will see Gillard face criminal charges and as a former lawyer most likely serve time or receive some type of suspended sentence.

How this happens, and how long it will take is a matter being discussed by constitutional lawyers – their dilemma is that a sitting PM has never had to face criminal charges whilst serving as a sitting PM before.   It will bring on a constitutional crisis and Gillard knows this and is why she remains defiant.  If she wins another term further delays can be expected.

Gillard’s hubris in staring down justice in the face of her own knowledge of her guilt is the measure of the women.   She will see Australia sink first rather then fall on her sword as she did when she faced the Slater and Gordon partners.   She is angry at how she was dealt with and she can blame nobody but herself – yet she is forcing a Nation to suffer her criminal past and she expects us to do it willingly.

Just how out of touch with reality is this behavior?

The disenfranchised ALP Supporter base:

ALP supporters are wandering aimlessly and their vote is up for grabs.   The Greens have only a slight chance of picking up some of this disenfranchised vote pool, the Coalition also need to step up if they want to win their proportionate share, and Bob Katter’s party might just be a winner of a few seats and become much larger in life.

The Independents in Windsor, Brandt, Oakeshott, and Wilkie will all struggle with Windsor the only one with a real shot of holding office.

Do these bookie numbers act as a real indicator of the public’s forecast on the 2013 election result?   Does it mean the ALP caucus should or needs to act against Gillard?

Perhaps their thinking might be that after the mess they have made of our Nation’s finances – some $300 billion in additional and accumulated debt  – they have agreed as a collective they cannot fix or undo what they have created.  

Any inaction on Gillard’s continued fitness to be PM would allow for the opinion that the collective inaction of the ALP caucus signals an apparent capitulation and acceptance of their fate.  This would then allow further treasonable like allegations to be claimed as they have acted against their sworn responsibilities as a part of their sworn oath of office.   

These ALP MP’s have harmed a Nation – and in doing so have imposed a $22,000 personal liability on all eligible voters as a future legacy to be repaid – you do not, nor should not reward that type of incompetency.

Each ALP MP and Senator has shown themselves and their support for Gillard by their inaction’s – not one ALP MP or Senator crossed the floor, nor spoke up against during parliamentary process during the current term on any vote relating to confidence, of censure toward Slipper, Thompson, or Gillard.

There can only be one conclusion – the ALP rules not allowing any sitting member to cross the floor destroys our form of democracy – when Party insists it be place above the Members conscience, and the will of the constituents they represent – then the Democracy this Nation operates under has been usurper.

The NBN (National Broadband Network) is floundering and all because the idiot in charge has no idea …

That would be Mr Stephen Conroy, a Senator from Victoria and a staunch supported of Julia Gillard.  Minister Conroy was handed his Senate position in 1998 and took office in 1999.

Background:

His background – according to his APH profile – has him working as a Union representative since he left University – and this paints him as another of Gillard’s ‘handbag brigade’  of idealist wannabe politicians who have zero practical experience in the workplace.

Senator Conroy’s history before he entered politics is summarised below:

Personal

  • Born 18.1.1963, Ely, UK.
  • Married.

Qualifications and occupation before entering Federal Parliament

  • BEc (ANU).
  • Superannuation Officer, Transport Workers’ Union.
  • Research assistant.

Local government service

  • Councillor, Footscray Council..

Yes – he is another immigrant as is Gillard and that is not to say he should be punished for being an immigrant – but what stuns is that he was a research assistant and then a Superannuation Officer before he became a Senator … please tell me – how does this limited work experience within the Trade Workers Union qualify him to be a Minister and the person in charge of a $40 billion NBN rollout?

He was appointed as Minister for Broadband, Communications and the Digital Economy from 3/12/07 under Kevin Rudd, and also as Minister Assisting the Prime Minister on Digital Productivity from 14/9/10 by Julia Gillard as reward for his efforts in the assassination of Kevin Rudd.   The extra Ministerial position gives him a boost in remuneration and perks …

In the early 2012 leadership spill Conroy was one of the more vocal opponents of Kevin Rudd.    His Opposition counterpart is Malcolm Turnbull, and whilst Turnbull sits in the HOR, and Conroy in the Senate – there is very little debate between the two over the Communications Portfolio.  Both the Government and the Opposition have alternative representatives in both Houses that speak on the Communications portfolio if questions are asked.   In other words They hardly ever face off against one another.

When the NBN was announced by Rudd as a part of the economic stimulus package during the GFC response – some 4 years ago – it was hailed by many as visionary.  As the end of the 2013 year approaches the number of people who have actually signed up for NBN registered some $2 million of revenue at last count for the current year.

Yea that’s right – a paltry $2 million.

Stack that up against the $40 billion infrastructure to be expended and you gain the knowledge that Conroy is in charge of perhaps the biggest infrastructure build flop ever.

The $2 million in gross revenues does not even cover the CEO’s remuneration package.

Something is seriously amiss with the NBN and the reluctance by consumers to take up subscription is evidence.   Conroy is desperate and sees the writing on the wall – all this money going out whilst the Government is under immense pressures to rein in expenditures.   So much so that to try and meet forecast NBN subscriber targets by Jun 2013 – Senator Conroy announced a new marketing strategy to entice the ISP’s – (Internet Service Providers) – to sigh up new NBN subscribers – read story below …

Bounty to lift NBN network take-up

INTERNET service providers are being offered a bounty for every customer they transfer to the NBN, prompting claims the $37.4 billion network’s subscriber base is being artificially inflated.

For the next six months, in the lead-up to the federal election, the company charged with rolling out the NBN will pay internet providers $108 for each customer that shifts to the new taxpayer-funded, superfast fibre-based or wireless networks. NBN Co has set itself a target to pass 341,000 premises with fibre-optic cabling and connect 54,000 of those by June. The most recently available statistics on NBN connections, valid to September 30 last year, showed just 52,014 premises had been passed and only 6358 had taken an active service on the NBN.

Opposition communications spokesman Malcolm Turnbull described the offer as a shallow attempt by NBN Co and the Gillard government to boost lagging subscriber numbers on the new network in time for this year’s federal election.

“Stephen Conroy is spending millions of taxpayers’ dollars to bolster NBN’s take-up rates by June 30 this year,” Mr Turnbull said.

“There seems to be no limit to which commercial commonsense will be abandoned in the interests of politics. This company earned $2 million in revenue last financial year and now it is offering many millions of dollars to ISPs to move their customers on to the NBN in order to dress up their roll-out figures for the election.”

The incentive scheme will run from this month until the end of June.

The federal election is expected to be held in the second half of this year.

In an amendment last week to the commercial contracts between NBN Co and internet providers, the network builder explicitly states that the payment would be for the purpose of encouraging “higher rates of activation and use of (fibre) and (wireless) services”.

The amended contract states that internet providers should pass on the savings to end users.

However, late yesterday the NBN Co did not commit to that pledge.

The company said that although the benefit would “generally” be passed on to end users, ultimately “the commercial relationship with the end user lies with the retailer”.

NBN Co denied that the incentive scheme had anything to do with the government, and there would be no additional cost incurred to NBN Co or, by implication, taxpayers. It said the costs were factored into its corporate plan.

NBN Co spokesman Andrew Sholl said: “We don’t want to be migrating everyone in the area to the NBN at the same time. So we’re looking at a number of standard promotional activities to help ensure a smooth migration for homes and businesses.”

The move to boost NBN Co’s subscriber numbers using financial incentives is at odds with what the company has previously said when quizzed on the low rate of activation on the new network.

In the past NBN Co and the federal government have defended the slow rate of connections to the new network by saying that was not a priority as all customers would eventually have to shift to the fibre network when Telstra’s copper network is completely switched off.

Internet service providers yesterday declined to comment on the incentive scheme, with the likes of Optus and Telstra saying they would consider the offer.

Some industry insiders were concerned with the proposal.

“It’s concerning because this is essentially NBN Co’s way of interfering with our customers when it should only operate at the wholesale level,” said one telco executive who wished to remain anonymous.

“It’s also worrying because the NBN Co will have to recover its costs at some point down the track.”

Migration incentives have long been mooted as a possible way for NBN Co to lift its connection numbers.

The government’s $25m 2010 implementation study into the viability of the NBN recommended that as much as $3 billion be paid to internet providers in incentives to help lure customers to the nascent network.

According to that joint McKinsey-KPMG study, retail service providers should be granted $300 per customer to help offset the costs associated with buying new customer equipment – such as wireless gateways and set-top boxes for IPTV services – and the costs of rewiring new premises to ensure they take full advantage of the superfast broadband speeds offered by the NBN.

The migration incentive will initially be available to premises in completed NBN areas, but the company has reserved the right to add new zones at its discretion.

The NBN is a failure and for 4 years Conroy has been out of his depth – being a Gillard supporter his portfolio Ministry is safe … but should it be so?

As with Minister Bowen and the Immigration cock-ups – Gillard Ministers see failure as OK because their Leader cannot make a move on them else risk her own tenure.

The NBN failings are all on Minister Conroy’s head – he needs a POKE – a stiff pointed object right in the area that will help make him stand tall and take notice … perhaps the Pickering appendage to all things Julia Gillard – i.e. her never without black dildo would do the trick …

In a climate where Telstra have had the wood on the Government from the get-go on the NBN and the still viable Telstra Copper Network – the $12 billion Conroy agreed to pay Telstra for the ownership/leaseback of the ‘copper network’ was textbook corporate malfeasance on Conroy’s part as the representative for the taxpayers and their monies spent.

As a part of the deal struck – Conroy allowed Telstra to pull planned upgrades from ADSL 1 to ADSL 2 exchanges without Telstra having to build in fail safe guarantees that existing ADSL 1 customers would not be disadvantaged by the ‘copper-network’ deal.

And again on Minister Conroy’s watch – when his office negotiated the ‘copper -network’ deal – Telstra was allowed to alter its ADSL 2 upgrades to align them with the NBN roll-out.

That meant Telstra had the option to pull the pre ‘copper-network’ deal planned ADSL 2 upgrades to its ‘exchanges’ and ‘pillar boxes’ or put them on hold.   That freed up Telstra capital and in many cases shoved the ADSL 1 customers on to the NBN roll-out time-frame.

As the NBN has become more polarised as the network everybody is going to be dependent upon – so is the importance for Conroy and his NBN Co to get it right.

At the moment that is not happening and Conroy is desperate to get his subscriber numbers up to satisfy budget quota forecasts before the end of the year.  Never mind the additional monies being paid over to Telstra and Optus to sign up their clients to the NBN – this only adds to the already ‘white elephant’ costs of the NBN.

NBN Co spokesman Andrew Sholl said above: “We don’t want to be migrating everyone in the area to the NBN at the same time. So we’re looking at a number of standard promotional activities to help ensure a smooth migration for homes and businesses.”

Again – why pay money to the ISP’s for the subscribers they hand over … offering free subscription to the subscribers saves the $108 promised to the ISP’s, and the service sitting there currently not being used gets used … nah … there is another deal at play here – the Government have given some undertaking they will not compete for existing Teleco’s ISP customers.   So instead – they have decided to buy them with taxpayers money.

Another example of the type of dickheads we have running this Nation … Corporate Australia runs rings around them.   Take the ‘MRRT’ tax collect, the carbon tax’ collect, the mammoth fraud of the ‘school building program’, and the  cockup’s associated with the ‘pink bats’ insulation fiasco … all examples of extreme incompetence by Government failing yo act responsibly with taxpayers monies.  

Why not offer NBN subscribers free service for three months to get them to sign up – offering $108 for each subscriber is a bribe offer to Telstra and Optus to give up their customers to the NBN – what do the NBN subscribers get out of the Conroy marketing plan?

ADSL 2 Upgrade roll-backs:

On the 31st Aug 2012 – Telstra announced cancellation of 109 ‘pillar-box’ upgrades across Australia – that means the ADSL 1 customers awaiting a planned and scheduled upgrade to ADSL 2, now have to wait for the NBN roll-out to get a better internet connection.

[The information on the 109 sites pulled is available at Telstra’s Wholesale web link – file linked here – opens an excel file … look at Sheet titled “Sites Removed 31st Aug 2012” … do an index/filter search via ‘postcode’ to find out if you’re affected.]

The upshot of these pulled upgrades is massive for the subscriber.  As for Telstra’s benefits – they are able to walk away from providing a better service to millions of their rural and regional subscribers, and the other ISP customers who feed off the copper-network backbone can’t offer a better service.

In Conroy’s desperation to get his hands on the Telstra ‘copper-network’ – he forgot to look after the rural and regional broadband clients who were already scheduled for Telstra planned ADSL 2 upgrades. 

For the subscriber – ADSL 1 clients pay the same cost as do ADSL 2 – Telstra does not price these services differently.   Yet the ADSL 2 service delivers speeds of up to 20,000 kbps as compared with the 8,000 kbps of the ADSL 1 service.

Telstra have no issue with charging the same price for the ADSL 1 and ADSL 2 service despite the alarming difference in the quality of service.

I have been battling Telstra for several years now trying to get them to recognise the disparity between rural and regional quality of service when compared with metropolitan areas where most of the ADSL 2 services are located.  

This same cost discriminating policy for a vastly inferior service is commercial in its implementation, and will not change unless Government regulators are given amended legislative powers to enforce unfair practices’ laws against Telstra. 

Of the 109 service upgrades that were cancelled on the 31st Aug 2012 and linked above – none have postcodes 2000, 3000, 4000, 5000, or 6000 – meaning all the planned upgrades were pulled in rural and regional areas.

There is no incentive for Telstra to upgrade the rural and regional ADSL 1 sites ahead of the NBN roll-out because the subscribers benefiting from the upgrade will not have to pay any additional cost for that upgrade.

Telstra has made a commercial decision – why spend infrastructure monies for upgrades that are revenue neutral, and that will be reimbursed by the Government as a part of the $12 billion deal for the copper-network when the NBN roll-out happens in those areas.

From Telstra’s perspective this makes commercial sense – for the Telstra clients having to pay for an ADSL 2 service yet will only ever have ADSL 1 speed – they have been screwed over by Telstra because dickheads like Minister Conroy, his staffers, and his NBN Co Executives did not extract a guarantee to protect existing Telstra/Bigpond subscribers from the cancellation of planned ADSL 2 upgrades.

In a recently requested Telstra Media response on what percentages of Telstra/Bigpond clients have ADSL 1 and ADSL 2 services – the response indicated:

  • Telstra has over 5100 exchanges nationally of which around 2800 are enabled for ADSL broadband (of these 2200 (79%) are equipped for ADSL2+).
  • ADSL supports speeds of up to 8Mbps downstream
  • ADSL2+ supports speeds of up to 20Mbps downstream

RURAL POPULATION IN AUSTRALIA: – data source linked here –

The Rural population in Australia was last reported at 2.43 million in 2010, some 11% of the 22.34 total population – this source data linked here – and according to a World Bank report published in 2012.

[Rural population refers to people living in rural areas as defined by national statistical offices. It is calculated as the difference between total population and urban population.  This is people statistics and not homes connected to the internet –  there is a high margin of error if using this data to benchmark internet users and their domicile.]

In a response from Minister Conroy’s office late last year – and some several months after initial inquiries were sent to Mr Conroy – the following was received: [click on images to enlarge in a new window.]

I have had two further conversations with Mr Mason since his letter was received and during the most recent – I advised him the new information about the 31st Aug 2012 pulled ‘top-hat’ ADSL 2 upgrades for the area I live in, and another 108 ‘pillar-box’ sites.  

His response in discussing the matter was dis-ingenuousness to say the least – his want was to get off the phone as quickly as possible – and to that aim he said I was – ‘wasting his time’, and continued with – ‘he had more important matters to be concerned with …’ – the matter remains unresolved and Minister Conroy’s and his staffers now avoid my efforts to contact them.

My contact and demeanor during these phone conversations was as always to try and get these type of bureaucrats to – ‘understand what it is that they do not understand …’ – Mr Mason just happen to be the ‘bug-boy’ my inquiry was directed to …  he is now fully aware of just how ineffectual his response was, and how his lack of understanding or acknowledgement of the larger issue at hand was a good reason for him to not want to talk about the matter.   He in not on my Christmas card list. 

Meanwhile some 600 Pillar box sites (21%) remain as ADSL 1 sites awaiting some form of upgrade and all at the whim of whether Telstra will pull those upgrades ahead of the NBN roll-out as well …

The battle continues …

This post commences a series of special ‘Election 2013’ year posts concerning issues, political candidates, polling data, and all other matters relating to the policy and discussion covering the 2013 Federal election.  

Today’s post highlights Penny Wong’s response to the Oppositions mini-election starter pack claiming to bring the budget back to surplus in their first year with some proviso’s.

In an article published in The Australian written by Ben Packham, he wrote:

TONY Abbott says he’ll get the budget into shape because it’s “in our DNA”, but won’t say how he’ll deliver one until just weeks before the election.

A fresh brawl over the surplus has marked the beginning of the political year, with Labor accusing the Coalition of a secret plan to slash health and education funding.

The Opposition Leader said his costings would rely heavily on the state of the budget that Labor, which had jettisoned its own surplus commitment, would bequeath an incoming government.

“We’ve got to see their figures before we can tell you exactly what we’ll do but I tell you what, the fiscal position will always be better under the Coalition because budget surpluses and reducing debt, paying back debt, that’s in our DNA,” he told Seven’s Sunrise program.

Mr Abbott is travelling the country this week on a mini-campaign to kick-off the election year, spruiking “fully costed” policies.

Abbott promises ‘cranes over cities’

But Finance Minister Penny Wong said opposition had fudged its numbers during the last election campaign and it costings claims could not be believed this time around.

“Well let’s remember that Joe Hockey is the shadow treasurer who delivered an $11 billion budget black hole in his last set of election costings,” she told ABC radio.

“Let’s remember he used auditors who were subsequently fined for professional misconduct in terms of his last election costings.

“He’s now claiming these so-called real solutions are fully budgeted and costed. I mean that’s simply a work of fiction.”

She claimed Mr Abbott’s “Real Solution’s” policy document had hidden the cuts he would make to health and education.

Mr Hockey said the Coalition could not be more specific on costings “because the government’s numbers keep changing”.

“And therefore until we get to the weeks before the election when the pre-election fiscal outlook is released by the Department of Treasury and the Department of Finance, we don’t know what the real state of the budget is and we do not know what the funding envelope is for our commitments,” he told ABC radio.

Mr Hockey said the Coalition’s commitment to a surplus remained emphatic.

“Based on the numbers published today, we will deliver a surplus in our first year and every year after that,” he said.

Senator Wong said the opposition would have to cope with economically volatile conditions should it win government.

“This is the nature of … what is happening in the Australian economy. And if the opposition say that they are able to govern they also have to deal with this,” she said.

Well ain’t that the pot calling the kettle black … this Government who from office, and who gave us equally balanced budget policies during the 2010 election with a guaranteed ‘never to be broken’ return to ‘surplus; by the 2012-13 year, have themselves delivered a track record of budget deficits as illustrated below:

  1. 2009-10 … $57 billion deficit –
  2. 2010-11 … $51 billion deficit –
  3. 2011-12 … $47 billion deficit … and the
  4. 2012-13 forecast was for a $1.5 billion surplus, but has been revised twice and now is estimated at a another $15 billion deficit.

If Senator Wong wants to blame Mr Hockey and the Opposition for an $11 billion error in a hypothetical experiment of policy costing arithmetic before the 2010 election – what credentials can she offer to support her claims her Government are better money managers?

In the real case scenario, her Government of the day made mistakes of $100+ billion in revenue and expenditure forecasts used to formulate and initiate policies over the term of the current Government?

This most recent clusterfu_k of budget errors administered under Gillard and Swan, despite all attempts to stop the carnage with new taxes and revised revenue forecasts, along with an expenditure growth in the forward estimates – have caused the National debt to blow some $100+ billion since the last election in 2010 – and by some $300+ billion since the ALP came to power in 2007.

Ms Wong – you have no perch upon which you can throw mud …

Politicians need to wake up – the electorate is not dumb – they never were – yet the narrative being used to score points in the battle to win votes treats the electorate as if they were a bunch of unthinking neanderthals.  You risk much with such a lame based debate with no creditability whatsoever from which to land your blows.

The electorate knows much more that you think and can tell when the bullshit meter registers ‘extreme crap’ –  as opposed to genuine and reliable comment.

Ms Wong – your star is falling and attaching yourself in any way to Treasurer Wayne Swan and his staffers will only flame you out that much quicker.

Do your own research as opposed to relying on staffers and public relations personnel aiming at a media cycle punch-line … get out there and talk about your own Government’s failings and how you are going to try and fix them .. and if you have no response or answer to that reality – then do yourself a favour and shut the fu_k up …

uch of my summer break has been spent on elements of social exclusion and discrimination.

Christmas can be a terrifying time for many decent people and as a society it is only in recent times, 3 odd decades, has so much debate arisen as to why suicide factors increase over the summer holiday season. A very all encompassing response is depression, but what circumstances causes this epidemic?

Since Sept 2011 the Commonwealth Department of the Attorney General has been considering a unified approach to the varying Federal and State legislations, tribunals and remedies available to address discrimination in its varying forms.

The following is an adequate definition of discrimination as supplied to the Attorney General’s Department – Consolidation of Commonwealth Anti-Discrimination Laws: Submission by Discrimination Law Experts’ Group on December 13, 2011. See link here

1. Unlawful discrimination

Discrimination is unlawful in public life unless it is justified within the scope and objects of this Act.

2. Definition of discrimination

Discrimination includes:

(a) treating a person unfavourably on the basis of a protected attribute;

(b) imposing a condition, requirement or practice that has the effect of disadvantaging persons of the same protected attribute as the aggrieved person; or

(c) failing to make reasonable adjustments if the effect is that the aggrieved person experiences unfavourable treatment under (a) or is disadvantaged under (b).

The conduct described in 2(a) and (b) is not mutually exclusive.

From those readings my suggested test of prohibited discrimination might be;

‘any attitude, practice or action or process that excludes any claimant, be that in the political, economic, social, cultural or any other field of public life’.

Lord Brown Wilkinson in the judgement in  Glasgow City Council v Zafar stated:

“[Discrimination claims] present special problems of proof for complainants since those who discriminate on the grounds of race or gender do not in general advertise their prejudices: indeed they may not even be aware of them.”

In a broader sense this is critical to the issue in the matter that has bothered me recently. A very senior civil servant, whose career has been built within various bureaucracy in human resource recruitment and capability, who has learnt a biased  Australian Public Service merit based interpretation on the job, unknown qualifications but unable to understand or apply the intents and purposes of anti-discrimination laws. From his perspective the morality of the matter is secondary to the myopic drive for cost containment. The lack of understanding of economic cost casts a dark shadow over all Public Service, including policy, and policy makers.

This attitude is then antecedent to all human resource practice throughout all industry.

Most sadly the Australian Public Service interpretation of merit based appointment, is heavily skewed towards incumbent public servants and their self-preservation and self-interest. It is widely entrenched by group think, and prohibits re-evaluation by more efficacious and productive thought, outsiders.

The following is but a small sample of Commonwealth Guidelines, Legislation and State Government Acts that cover discrimination. [The Universal Declaration of Human Rights was 1948 and there are other forerunners like Magna Carta 1215 or 19th century philosophers including William Henry Thoreau amongst others.]

  • Discrimination Act 1991

  • Equal Opportunity Act 1984
  • Gender Reassignment Act 2000

Tasmania

  • Anti-Discrimination Act 1998

The oldest Australian legislation listed is 1975 and that supports my argument that this is relatively new developments in Human Rights and equity or equality.

The Federal Court has now developed a body of adequate jurists in these matters, however too often access is denied to the most vulnerable through cost eg the disabled, the Indigenous, the unemployed or long-term unemployed amongst others. So Legal Aid and other conciliation forums too must meet a more exacting standard.

The United States and Canada have both adopted consolidated Acts. One Canadian section states; “For greater certainty, a discriminatory practice includes a practice based on one or more prohibited grounds of discrimination or on the effect of a combination of prohibited grounds”.

This is somewhat addressed in the definition of discrimination above 2. Far too often all legal jurisdictions rely upon claims under a statutory legal provision or precedent. When the claim is dismissed under that provision is an adequate and cost-effective appeal process available?

An excellent example might include discrimination on the basis of an irrelevant criminal record, not only in employment, but in accommodation and goods and services (etc), prevents former offenders from participating in the community and results in further social exclusion. Another excellent case study example I came across in the earlier listed submissions was an indigenous genetically disabled woman where her disability was an affliction that caused lack of balance in walking. She was constantly arrested as being intoxicated. Would she seek relief under Sex Discrimination Act, Racial Discrimination Act or Disability Discrimination Act, when the matter of intoxication is bought before a Local Court Magistrate? A genetically induced Disability…..charged with being drunk.

I can only support the consolidation initiative. It is trite that it has required other Western Countries to lead the way!

Even when the Australian Legislation is enacted problems will remain. Will Australian government abide by their own policies and procedures? Will they democratically support the independence and transparency of the judicial process? How do we keep it is cost effective?

Last year the Federal Attorney General’s behaviour was questioned several times particularly relating to the matter of James Ashby v Commonwealth and Federal Member of Parliament Peter Slipper. The bi-partisan nature of the Judge was called into question when the case was dismissed ruling the claims were politically motivated. Sexual harassment is abhorrent. This is not an issue of discrimination but an example of government acting out of self-interest. The text messages caused Slipper to resign the parliamentary speakership. That whole affair is so sordid. The independence and transparency of the judiciary is paramount.

For me the biggest unanswered question in the Peter Slipper hearing remains why was the judgement of the matter reserved for a couple of months. It was ultimately given only after parliament was in recess.

How many less sensational but apparent abuses of judicial process are not reported and subject to the same level of public scrutiny.

In the discrimination issues I have been pondering if I need to be careful of subjudice and undertakings to not discuss process.  A basic Human Right is freedom of thought and freedom of expression. To achieve Human Rights at the anti-discrimination level, Human Rights are breached regarding freedom of speech.
