T he Australian much loved cartoonist Larry Pickering has taken up the baton to right what he saw as a wrong, and what a big wrong it is.

The Gillard AWU story started way back in 1992.  Glenn Milne who had been doing some deep background had interviewed Gillard in 2007 when she made her famous ‘young and naive’ comment.  Milne again broached the subject with more information in late Aug 2011 as did Mike Smith of 2UE fame.  Both were again going to report on the story.

Milne’s story was actually published, Smith’s was pulled by 2UE Management only minutes before it was to go to air.

Julia Gillard has lost all authority within the broader Labor movement.

THE real import of the alleged brothel creeping scandal surrounding Craig Thomson has been missed. And it is this: key factions and unions within the Labor movement are now openly indifferent to the fate of either Julia Gillard or the federal government. They simply don’t care any more.

Gillard has now lost all authority within the broader Labor movement. By their actions in the Thomson saga they have signalled a judgment that she cannot win the next election. Settling internal scores and power struggles is therefore now more important than whatever happens to a lameduck PM who can’t haul her primary voting numbers out of the pathetically fatal mid 20s.

The Mafia-style dirt-covered shovel — code for digging your own grave — dumped on Friday at 3.30am on the doorstop of Kathy Jackson, the union official who had the courage to refer Thomson’s activities to the police, may as well have been delivered to the Lodge. For Gillard it is now that bad. She is simply regarded as collateral damage and large sections in the Labor movement are uninterested about whether she’s terminally wounded or not as they go about their internal bloodletting. It is about to get worse as elements of the Australian Workers’ Union seek to settle up with Thomson’s accusers by demonstrating that Gillard herself was implicated, albeit unknowingly, in a major union fraud of her own before she entered parliament.

On Friday, Michael Smith of 2UE contacted me to check the veracity of material in a statutory declaration drawn up by Bob Kernohan, the former president of the AWU, and dealing with the relationship between Gillard and Bruce Wilson, which I outline below.

On Saturday, Herald Sun and Daily Telegraph columnist Andrew Bolt wrote on his blog: ‘‘On Monday, I’m tipping, a witness with a statutory declaration will come forward and implicate Julia Gillard directly in another scandal involving the misuse of union funds. Gillard herself is not accused of any misbehaviour at all. I do not make that claim, and do not hold that belief. But her judgment — and that of at least one of her ministers — will come under severe question. She will seem compromised. It could be the last straw for Gillard’s leadership.’’

Big call. But I do have a good deal of knowledge regarding Bolt’s claims. On Sunday November 11, 2007, just days before the November 24 election I interviewed Gillard, then deputy leader of the opposition, in my capacity as political editor for News Limited’s Sunday newspapers. The interview concerned the embezzlement of union funds — not disputed — and later the subject of a court conviction by a former boyfriend of Gillard, Bruce Wilson. I had researched the piece for months. It was the most heavily lawyered article I have ever been involved in writing. The story said that as a solicitor acting on instructions, she set up an association later used by her lover to defraud the AWU. But she has strenuously denied ever knowing what the association’s bank accounts were used for.

Gillard, then in her early 30s, was a lawyer with Melbourne based Labor firm Slater & Gordon. At the time of the fraud she acted for the AWU. She met Wilson, then the West Australian AWU secretary, while representing the union in the Industrial Relations Commission. Wilson later moved to Melbourne to become Victorian secretary of the union.

‘‘These matters happened between 12 and 15 years ago,’’ Gillard told me. ‘‘I was young and naive. I was in a relationship, which I ended, and obviously it was all very distressing. I am by no means the first person to find out that someone close turns out to be different to what you had believed them to be. It’s an ordinary human error.

‘‘I was obviously hurt, when I was later falsely accused publicly of wrongdoing. I didn’t do anything wrong and to have false allegations in the media was distressing.’’

What the lawyers would not allow to be reported was the fact that Gillard shared a home in Fitzroy bought by Wilson using the embezzled funds. There is or was no suggestion Gillard knew about the origin of the money. We now await the issue to which Bolt refers.

If it comes, and if it is powerful as Bolt suggests, it will be further evidence that the Victorian Right represented by the AWU is involved in a life and death struggle with the Right as represented by the Hospital Services Union. Thomson was a senior official of the HSU for 20 years before entering parliament via the seat of Dobell.

The HSU split several years ago into two factions. Thomson was supported by Jeff Jackson, Kathy Jackson’s former husband. This so-called old guard was the support base for Victorian right-wing power boss, David Feeney. Feeney is now looking for a parliamentary seat because Gillard’s abysmal numbers have made his third Senate spot vulnerable.

A defeat for the old guard by way of a successful prosecution of Thomson by police, would leave Feeney powerless and without a base or a seat.

Jackson himself has been accused of using union money on escorts with enemies of the Victorian HSU boss releasing bank statements showing payments to the same Sydney brothel where federal MP Thomson’s credit card was allegedly used. Jackson has denied the claims. Ultimately at issue here could be the succession to Gillard, and I’ll explain why.

When Kathy Jackson called in the wallopers, the stakes were high. Because a federal defeat for Thomson and his allies would enhance the power base of Victoria’s two other factional king makers, Bill Shorten and Stephen Conroy who are both aligned with the new guard in the HSU. And we all know what Shorten’s ultimate ambition is.

What a tangled web we weave especially when you consider Thomson is married to Zoe Arnold, a former Transport Workers Union official and adviser to former NSW Health Minister Reba Meagher. Alex Williamson, daughter of HSU national president Mike Williamson, is an adviser to Gillard. And, of course, as mentioned, Kathy Jackson, who blew the whistle on Thomson, was married to former Victorian state HSU secretary Jeff Jackson.

Truly the NSW Disease has arrived in Canberra.

Meanwhile amid all this interbred internecine manoeuvring Gillard attempts to adopt the high ground, attacking shadow attorney-general George Brandis for intervening in the course of justice. On Thursday morning Gillard attacked Brandis for speaking to NSW Police Minister Michael Gallacher at a time when the allegations against Thomson were being assessed by NSW Police. Unfortunately she got her facts wrong because the NSW police only announced they were conducting an assessment four days after Brandis spoke to Gallacher and in fact only got Brandis’s dossier three days after he spoke to Gallacher.

A small point but one that indicates the pressure is beginning to show on Gillard as she desperately searches for points of deflection. During the same press conference she also vainly tried to defend Thomson’s decision not to make a statement to the parliament on the facts. We all know why; if he lies he’s finished as an MP and Gillard is washed up as Prime Minister. Gillard and Thomson are shackled together just as surely as two First Fleet convicts.

Oh, and here’s a small postscript on which to end. On September 7 at the Wyong Christian School at 2pm there will be the opening of a new hall built with funds from Gillard’s time overseeing the Building the Education Revolution. Thomson is scheduled to attend as the local member. My gut instinct is that both he and the Prime Minister will be otherwise engaged.

What is interesting is – if what Milne reported was false Gillard had a massive libel suit in the offering.  The fact that she settled for an apology and a retraction meant she was either ill-advised, or she knew the story was for the most part factually true.  That had to have set off alarm bells for all the Media chiefs.

This has been lost in what has transpired since.  Rather than take the Media to Court under defamation laws – Gillard was content to settle cheaply from a Media perspective.  What is not known is did News also settle with Gillard on a financial scale?

This has never been disclosed or asked from what can be established.

There were many other stories in the archives that had relevance.   Any claim by Pickering that he initiated the story is clearly false.

To give him his dues he has picked up the baton and has taken it to a point where named radio starts including, Alan Jones, and one Derryn Hinch have run with the story.

ALP MP Robert McClelland also raised the matter in The House a few months ago.  It was an obscure speech and those who have been following the story did pick up the context.

This McClelland speech raises an interesting point – if McClelland knew of this fraud when it first happened 20 odd years ago – why as an MP did he not raise the matter when Gillard became elected to Parliament.  How could he in all good conscience let all of Australian be led by someone involved with a crime as he knew it to be?   How many other Labour MP’s were also in the ‘know’ and learnt to live with it?

This clearly damages the ALP brand in a way that should involve the AEC, the Federal Police and any other relevant authority so charged with finding out who had what knowledge, and who was involved with the cover-up, and how someone with a track record such as Gillard’s could ever be pre-selected to run for public office.

I’ve digressed – sorry – the thrust is to give Pickering his dues for having carried the story thus far.

For about four months now Pickering has had a Facebook page that contained short stories about his life experiences and his oh so clever Political cartoons about the current Government.  His follower base has steadily grown and now boasts around 6,000 on-line followers.  His readership is much wider.

He picked up the AWU story shortly after Facebook banned him for publishing cartoons of Gillard wearing a monster of a ‘black dildo’.  He drew her regularly and she always had the dildo in place – the Facebook banning grew his popularity and several followers took to their own pages to have the ban overturned.

Since that time Pickering has been committed to exposing this story in full.  In fact he is so sure of his sources and evidence that he has dared anybody to come after him with a writ to try and shut him up.  As yet nobody has taken up the challenge which more than suggests that Gillard really is in trouble.

Larry Pickering is no professional journalist.  His way of leaking parts of the story to his rabid readership has flayed them up into a frenzy.  His mega offerings are enough to keep his ‘Pied Piper’ followers on the case and spreading the word via coping and pasting his Facebook posts to as many people who will read what he has to say.

Larry’s presentation of his facts and take on the story reads like a soap opera – and as indicated – a professional journalist would have wait until the whole story was in, and had been approved by legal and the like before they went public.

Pickering has indicated on-air that he has had legal people involved from the outset.   His business and life experience make him no fool – so when he says he’s got it – Gillard had better belive it.

Let us ponder what might happen for a moment going forward – let us say that Pickering has all that he says he has in that it will bring down the Government – that is not going to happen just on his bog posts and the media claiming all that has been done and producing evidence to back it up.

The prosecution process requires the Police or other relevant authority that will deal with this to first of all establish its point of reference, and what its authority is to be.   For starters – where will you find a Federal or State prosecutor to pick up the mantle?

Constitutional Lawyers will debate this among themselves for months trying to find precedent and a way to unseat a sitting PM for alleged corruption some 20 years ago.  It will be a frustrating and protracted process.

If Gillard resigns under the pressure than legal proceedings will become a matter of course.  If she does not – how do you go about a process to establish charges against a sitting PM?  And then – how do you enforce the legal proceedings on a sitting PM?

Larry Pickering needs to think this through if he already hasn’t.   Stating on-air that Gillard only has ‘weeks left in the job’, sounds appeasing to those who want a change of Government – but the protocol to be followed will ensure that this Government will most likely last well beyond Christmas and possibly through to the next election if Gillard digs in.   Of course the ALP caucus can grow a pair and save itself some historic humiliation and do the job for the electorate at large.

Since Gillard stared down both the Fairfax and News media in August last year – the mainstream media have been looking for a way to have this matter exposed via other means.

Two days ago a News journalist asked a direct question of the PM as reported … here … – well that same journalist is no longer working for News.  It’s been reported by Pickering that he took a redundancy package the same day he asked the question.

What is it that she has over the Media Barons?

It is not beyond the realms of belief that Pickering is a stooge front on behalf of News or Fairfax … his Facebook outlet only started earlier this year – ‘The Pickering Post’ is just on a month old – Pickering’s sources for News generally carry ‘AAP’ as the source but that could be sourced from any other media proprietor.

If he is doing this in a completely independent manner and that is what I believe to be the case – than he truly deserves recognition for his efforts thus far.

    Urban myths are very funny things.

    They always rely upon first hand accounts which are very tenuous. You always wonder why any person needed to tell the story with such conviction.

    We have the issue with HSU East, which has festered for about 2.25 years. It is based on Kathy Jackson’s account. It has gone on for too long. It needs resolution. Other than damnation of Williamson, what then follows?

    We have the Slipper scandal, which is now right in the mix. Is it paedophile (29 year old victim (known gay with questionable past)) v Speaker of the House of Representatives respondent) or Position of power (29 year old victim – Speaker of the House of Representatives respondent) or simply guy who is now endorsed in seat by LNP v dirty filthy rat who deserted the minority opposition.

    Now we have AWU, AWU, AWU, Scandal Scandal Scandal, which is Source Bob Kernohan, Reporter Larry Pickering, secondary source Alan Jones & Usain Bolt (the Bolt Report) and yet no one knows what to think or believe. Jury by public opinion is simply not OK.

    We understand the perspective of Alan Jones. I have no idea what the Bolt Report is. I do not follow him on Twitter. What a great pun. Be a twit on Twitter.

    Larry Pickering is some sort of Bob Hawke groupie. Who cares.

    Yesterday Australia, all of us, Julia Gillard and Tony Abbott, the government and the opposition moved forward on the immigration debate, yet we continue to carry on with this nonsense.

    If there is any validity to any of it, why is Tony Abbott trying to tell us that the policy of our second longest serving prime minister, who was defeated in his own seat, was right, Isn’t it time to try to move on. We are not interested in 1996 or 1995 or 2007. We are now dealing with 2012/13 and trying to get to 2013/14 or 2014/15.

    If Julia has done something wrong, then bring on the affidavits.

    Conversely deal with the now. Our currency is crippling jobs. Our mining and banking sectors are rampant. Today CBA announced a 7.1 billion dollar profit. The largest in history outside mining. Yet we all are on the slopes, staving off depression or bankruptcy. CBA CEO promised no more grandiose executive payments. When he is earning $8 million per annum.

    We actually need to start dealing with the here and now. Stealing $5 from any union is disgraceful, endowing yourself with emoluments with %153,846 per week is simply without shame.

    Bob Kernohan has been trying to recover the funds from Wilson and Blewitt’s scam for 17+ years. The Union with Ludwig there calling the shots have kept him at bay … why now is the obvious question …

    It seems that during Howards reigh – the ALP Union faction stepped up and began to place its nominees in positions to serve in higher positions. They needed a non-union MP to defeat Howard and that became Rudd – once in power the Unions began to work the numbers and awaited the right timing. That happened June 2010 – and the rest is history.

    The Unions reps serving in the Cabinet have shown they have no idea how to run a Nation – not in the way Australians want to be Governed. The longer Gillard stays at the helm the bigger the defeat at the next Federal election.

    Pickerings role in this is still to be played out. It won’t happen until it is revealed why the media have stayed silent on the biggest story even in this Nations history.

    So in response to Gerry Hatrick – it is a big deal – and yes there are other issues at stake – but whilst we become the laughing stock of the world as Nixon became during ‘Watergate’ – awaiting the slow death by a thousand cuts – and then his eventual resignation – and the Republican voted out of office at the next election – Gillard is no Nixon – her resilience is all ego and a misguided belief that she deserves to be the PM. WHo will have the balls to evict her?

    Someone needs to talk her down … she has to face her accusers and tell her story based on a truth that has never been told before.

    A Nation awaits its deserved honesty.

    While all of that rings true, Australia is faced with going to the polls and electing a liberal government, hell bent on going back to Howard’s era, or trying to affect an alternative.

    Do you believe the ALP with a different leader, and stronger frontbench will affect that alternative. For me it is all very sad, because we are not addressing more real stuff like the excesses of the banks, the miners, and this two speed or multi speed economy. Australia is not the egalitarian place we all aspire for it to be.

    What I believe is that neither side of Politics offers a viable alternative – Gillard has been marched into a corner over the asylum debacle – she has suffered such loss of face in the forced backflip – and despite whatever else might be revealed – this clusterfuck on its own will see her and her Cabinet done …

    The budget surplus is gone – Conroy’s nose-bleed interview on Channel 9 this morning where he forgot his lines and repeated himself whilst appearing to be suffering a dry-mouth attack exposed his shortcomings when things go off script.

    The Banks, the Miners, the only two industries keeping Australia afloat at the moment – and the criminal aspects to the obscene profits make us all cringe, especially the CEO payments based on share performances – yet as a banker in a past life the return on assets is still around the 1% level and that sobers up the obscenity … a full year dividend of just under $4 against a current share price of $55 means a return to shareholders of around 7% before any franking credits are applied.

    Against official interest rates of 3.5% and super returns around 5-8% this is comparable.

    Your question on a different leader and alternative front bench – the pool is not deep enough to replace the front bench – as for the Leader if it be another Union appointee then the short answer is No … Rudd is an enigma – you want him and then you ask why should he after what was done to him … the only acceptable resolution is an early election and Gillard and her team will not go there … unless of course she is forced from the Lodge due to other circumstances related to past deeds …

    You know as well as I do that industry like Tourism is done for a decade – trained staff have had to go elsewhere for work – infrastructure has lapsed and resorts have been mothballed. The high A$ value will keep tourists away and encourage Australians to travel off-shore – this Government is too dumb to work out that equation and the many other similar stories …

    The fact is that all Government has lost its purpose – Local, State, and Federal and it is about the balancing of the budget – there is not enough money being generated and Fat-Cat public servants are on a lifestyle spree on the dime of the public.
    From their perspective it’s all about the ‘me’ and what can I do for me whilst I’m here – this is despite the generous super scheme and the other perks – not to mention the honour involved in serving the people … no … politicians have forgotten their mandate even though the swear it every day …

    Six months into the new LNP Government – Newman’s razor gang cuts have already spooked QLD’s and the poll tide is turning

    The media have become a casual as the MP’s themselves … fill a space on a newspaper page that carries the advertising … their demonstration of fear in the face of ‘blackmail’ by the PM demonstrates the strength of the media in this Nation …

    I don’t see any Leader – either serving in the House or around the Nation who could lift this Nation out of its lethargic slump and gradual march to mediocrity ….

    Thanks for the input Shane – have tried to get your contribution out there – am a subscriber and also like the tone and direction your posts take. Been following your contributions since I started covering the scandal. Would like to know where you think I’ve got the ‘facts wrong’ – not too concerned if it is in the peripheral, but very concerned if it is in the context of the mainstream subject matter reported.

    Keep up the good work …
